Your Agreement, Plain and Simple

Keep this open next to your full agreement. Each point here follows the same order, section by section, so you can read along side by side.

This page is a guide, not a substitute. It follows the Master Agreement section by section, in the same order. If anything here ever reads differently than the Master Agreement itself, the Master Agreement is what governs.

How This Agreement Works
  • 0.1Everyone who signs as Client, whether that's one of you or both, is responsible together for the Client side of this agreement.
  • 0.2It's made up of four parts: your Service Summary, your payment schedule, these Master Terms, and any signed change order, each covering a different piece.
  • 0.3It only becomes official once everyone has signed and the retainer has cleared. Until then, your date isn't held.

Services, Booking and Payment
  • 1.1You're only getting what's listed in your Service Summary, nothing added from the website, a pricing guide, or an earlier conversation.
  • 1.2A bundled or $0 item still has real value. Skipping it doesn't lower your total.
  • 1.3Your retainer reserves the date and starts planning. It's part of your total, not an extra fee, and it's nonrefundable except in the specific situations spelled out elsewhere in this agreement.
  • 1.4Your payment schedule lays out each installment. Whatever's left after those, your final balance, is due seven days before the wedding, no matter how you pay.
  • 1.5If a payment is late, coverage or delivery can pause, and continued late payment after written notice can lead to cancellation.
  • 1.6Nothing is delivered, gallery or products, until everything is paid.
  • 1.7Any processing fee will be shown to you before you pay, never added as a surprise.
  • 1.8If you ever want to dispute a payment with your bank or card company, let us know in writing first and give it ten days.

Changes, Overtime and Courtesies
  • 2.1If something about your day actually changes, who's shooting, where it's happening, the hours, or what's included, that needs a signed change order before it's official, not just an email agreeing to it.
  • 2.2Normal planning, timelines, shot lists, logistics conversations, isn't a change and doesn't need one.
  • 2.3The one exception is wedding-day overtime, which is approved and priced on the spot by text, email, or a HoneyBook message, not just verbally.
  • 2.4A one-time favor is just that. It doesn't change what's expected going forward.
  • 2.5You're welcome to request added hours, photographers, film, or other services, availability and current pricing permitting. Scaling down or moving to a smaller collection doesn't automatically lower what you've already agreed to pay. Either way, it becomes official through a signed change order.

Cancellation and Rescheduling
  • 3.1You can cancel any time with written notice.
  • 3.2What's owed depends on how close it is to your wedding: more than 180 days out, it's your retainer; 91 to 180 days, half your investment; 31 to 90 days, three-quarters; 30 days or fewer, ninety percent.
  • 3.3Anything you've already paid counts toward that number. Any shortfall is due within ten days, and any overpayment is refunded within thirty.
  • 3.4You're also responsible for approved, nonrecoverable costs already spent on your behalf, like a deposit paid to another vendor, though the total you owe is capped at your investment plus those costs.
  • 3.5If your date gets rebooked with comparable services, the net revenue from that, after any extra costs, gets credited back to reduce what you owe.
  • 3.6You can request one reschedule, at least 90 days out. Your original price holds if the details stay basically the same; you cover any added costs if they don't.
  • 3.7If we can't agree on a new date within 30 days of your request, or it's a second reschedule, pushed more than a year out, or requested too close to the wedding, it's treated as a cancellation instead, unless it's caused by a genuine emergency, which Section 7 covers.

Coverage and Client Responsibilities
  • 4.1Coverage starts and ends at the scheduled time, even if the day itself runs late.
  • 4.2Send final locations, access details, and your timeline at least 30 days out.
  • 4.3You're responsible for permits, venue restrictions, and things like parking or admission costs.
  • 4.4Get your family photo list in at least two weeks out. We'll do our best with it, but can't promise every single grouping.
  • 4.5If you won't be reachable that day, name someone who can make quick calls on your behalf.
  • 4.6A meal is required for any photographer scheduled past six consecutive hours. Without one, a reasonable break will be taken during coverage.
  • 4.7We're your only hired still photographer unless otherwise agreed. Guests and a videographer are welcome as long as they're not in the way.

Creative Control, Delivery and Image Rights
  • 5.1You've seen the portfolio and booked this exact style. Editing follows that same style.
  • 5.2The final gallery is a curated set. Duplicates, test shots, and unusable frames are left out, and there's no promised image count unless it's written into your package.
  • 5.3Raw, unedited files aren't part of what's delivered.
  • 5.4If something looks like an actual editing error, flag it within two weeks of delivery. Beyond that, further retouching or re-editing may be declined or quoted separately.
  • 5.5Personal taste alone isn't grounds for a refund or reshoot if the work matches what you booked.
  • 5.6Your gallery typically arrives 8 to 10 weeks after the wedding, and no later than 12, once everything's paid, though certain delays can reasonably extend that.
  • 5.7The gallery stays live for three months, so download and back it up before then.
  • 5.8You receive a personal-use license to keep and use your images forever. The DV Image retains the copyright.

Image-Use Preference
  • 6.1You choose whether your photos can appear in our portfolio and marketing, or stay private.
  • 6.2If you don't choose, private is the default, meaning your photos won't be used in marketing or shared publicly. Necessary private handling, like editing and delivery, still happens as normal.
  • 6.3Your choice only covers you, not anyone else in your photos who hasn't agreed to it themselves.

Team, Safety and Force Majeure
  • 7.1If Daniel is your listed lead, that's who shows up, barring a genuine emergency.
  • 7.2If that happens, reasonable effort goes into finding a qualified replacement who meets DV Image standards. If none is available, the refund terms in this agreement apply instead.
  • 7.3A second photographer's hours are separate from the lead's. Extending one doesn't automatically extend the other.
  • 7.4Please help keep the day safe and respectful. That protects everyone, including your coverage.
  • 7.5Severe, unexpected events like weather, illness, or disaster mean rescheduling gets tried first. If no new date can be agreed on, the cancellation terms take over from there.

Limitation of Liability
  • 8.1Real precautions are taken with gear and backups, but no one can promise absolutely every moment.
  • 8.2If something is genuinely lost despite that care, you get a fair refund tied to what was actually affected.
  • 8.3None of this protects against gross negligence or willful misconduct, or anything the law simply won't let be limited. That's never excused.

General Terms
  • 9.1Official communication happens through HoneyBook or the emails on file.
  • 9.2Your Service Summary, payment schedule, these Master Terms, and any signed change orders together make up the whole agreement. Nothing from earlier conversations changes it.
  • 9.3A one-time exception never becomes a standing rule.
  • 9.4If any single part of this agreement were ever found unenforceable, the rest still stands.
  • 9.5New York law applies. State matters go to Nassau County, and federal matters go to the Eastern District of New York.
  • 9.6An electronic signature counts the same as a handwritten one.
  • 9.7The important parts, payment, copyright, liability limits, don't disappear once the wedding's over.
